First: Introduction

Welcome to the My Business Manager PA application.

This document sets out the terms and conditions of use and the privacy policy of the My Business Manager PA application, and clarifies the rights and obligations of all users of the application, whether they are users or clients, as well as service providers.

Please read this document carefully before using the application. Downloading the application, creating an account, using any of its services, or clicking the “Agree” button constitutes your full, final, and unconditional acceptance of all the provisions contained in this document.

Second: Definitions

1. The Application or the Platform:
Means the My Business Manager PA application, together with all of its digital services, its website, and its affiliated platforms.

2. The Company:
Means My Business Manager PA Company, the owner and operator of the application.

3. The User or the Client:
Means any natural or legal person who downloads the application, registers on it, or uses any service through it.

4. The Service Provider:
Means any independent person, establishment, or company that offers its services through the application.

5. The Service:
Means any service that is requested, performed, or coordinated through the application.

Third: Nature of the Application and the Services

The My Business Manager PA application operates solely as an electronic and technical intermediary platform, intended to connect clients with independent service providers.

The Company is not considered a direct provider of any service offered or performed through the application.

The services are carried out entirely by independent service providers, who bear full responsibility for the quality of the services and their outcomes.

No employment relationship, legal partnership, agency, or legal representation arises between the Company and the service provider.

The User acknowledges that any dealing with a service provider takes place at the User’s own personal responsibility.

Fourth: Eligibility to Use

By using the application, the User acknowledges the following:

That the User has reached the legal age in accordance with the laws of the State of Qatar.

That the User has full legal capacity to use the application.

That the User will use the application only in a lawful and legitimate manner.

That the User will not use the application in any unlawful activities or activities that violate Qatari regulations.

Fifth: Account Creation

The User undertakes to provide accurate, correct, and up-to-date information when creating an account or using the application.

The User bears full responsibility for the account data, the password, and any activity carried out through the account.

The Company has the right to suspend or cancel the account if the data is incorrect, in the event of misuse of the application, or where legal or security suspicions exist.

Sixth: Monthly Subscription and Cancellation of Subscription

When the User subscribes to any of the packages or paid services offered by My Business Manager PA Company, the User acknowledges and agrees that the subscription constitutes a contractual commitment on a monthly basis for a full year, in accordance with the subscription period and the terms specified in the package subscribed to.

Once the subscription is completed and the prescribed fees are paid, the User is considered a client of My Business Manager PA Company throughout the subscription period, and the User’s relationship with the Company during this period is subject to the terms and conditions of this document and to the Company’s approved policies.

Should the client wish to cancel the subscription, the client must submit a cancellation request through the Company’s official approved channels, stating the reason for cancellation whenever the Company requests this.

My Business Manager PA Company reserves the right to review subscription cancellation requests and to examine the reasons for cancellation and the circumstances associated with them. The Company may, in accordance with its internal policies and procedures and the applicable laws and regulations, take the appropriate decision regarding the cancellation request, including approving it, rejecting it, or determining the effective date of cancellation, depending on the nature of the subscription and the obligations arising from it.

The mere submission of a cancellation request shall not be deemed automatic approval of the cancellation or of the refund of any amounts paid, unless the Company decides otherwise in accordance with its approved cancellation and refund policy.

The client acknowledges that the paid subscription and the services associated with it may give rise to financial or operational obligations during the subscription period, and that any cancellation or refund is subject to the terms and conditions and to the cancellation and refund policy approved by the Company.

The Company reserves the right to review or update its subscription, cancellation, and refund policies from time to time, in a manner that does not conflict with the laws and regulations in force in the State of Qatar.

Seventh: Services and Orders

All services are performed by independent service providers.

The Company does not guarantee the quality of the service, the timing of its performance, its availability, or its results.

The Company reserves the right to refuse or cancel any order in the following cases:

If the order is contrary to the law.

If it is contrary to Qatari customs and traditions.

If it poses a legal or operational risk.

If it conflicts with the Company’s policies.

Eighth: Prohibited Services

My Business Manager PA Company is committed to respecting the laws of the State of Qatar and Qatari and Gulf customs and traditions.

Accordingly, the application does not provide, facilitate, or support any services related to the following:

Alcoholic beverages of all kinds.

Cigarettes, narcotics, or any legally prohibited substances.

Fraud, money laundering, or forgery.

Any services that violate societal values or that are unethical.

Ninth: Legal Disclaimer

The Company bears no direct or indirect responsibility for the quality of the service, delays, cancellation, financial losses, or disputes that may arise between the client and the service provider.

The service provider bears full legal responsibility for the services that it provides.

Tenth: Payment and Financial Fees

The application may impose fees on certain services, or operational fees.

Payments are made through the approved payment methods, such as bank cards, Apple Pay, electronic wallets, and other official methods approved by the Company.

All payments must be made through the Company’s official approved channels only. Please refer to the disclaimer section below for further details.

Eleventh: Cancellation and Refund Policy

The User may cancel the order before the service provider confirms it.

Once performance of the service has begun, the amounts paid are considered non-refundable.

In the event that a refund of any amount is approved, 5% of the total amount is deducted as administrative fees.

Twelfth: User Ratings

The User has the right to rate the services provided through the application.

It is prohibited to use the rating system for abuse, defamation, extortion, or unjustly harming the reputation of any party.

Thirteenth: Prohibited Use

It is prohibited to use the application in any activity that violates Qatari law, customs and traditions, or societal values.

It is likewise prohibited to attempt to hack the system, to tamper with any of its components, or to use the application in a manner that harms the Company, the users, or the service providers.

Fourteenth: Intellectual Property

All rights relating to the name of the application, the Company’s logo, the designs, the software, the content, and the visual elements are the exclusive property of My Business Manager PA Company.

None of these rights may be copied, used, or republished without the prior written consent of the Company.

Fifteenth: Privacy Policy

The Company collects certain personal data, such as the name, phone number, location, and usage data, for the purpose of operating the application and improving the quality of the services.

The Company undertakes to protect users’ data in accordance with the laws in force in the State of Qatar.

Users’ data is used only for purposes related to providing the services, improving the user experience, and communicating with the client when necessary.

Sixteenth: Governing Law

This document is governed by and construed in accordance with the laws of the State of Qatar.

The competent Qatari courts shall have exclusive jurisdiction to hear any dispute that may arise out of the use of the application or the services associated with it.

Disclaimer

In the interest of protecting the rights of our valued clients, we would like to note that the Company is not responsible for any funds transferred or paid outside the Company’s official approved accounts, or to any person who does not hold official authorization from it.

All payments must be made through the official approved channels only.

Any transfer or payment made directly to individuals or entities outside the scope of the Company is entirely at the client’s own responsibility.

The Company reserves the right to refuse or decline to approve any request for which there is no official proof of payment issued by the Company.
